01Acceptance of these Terms#
Effective date: October 5, 2026.
These Terms of Use (the “Terms”) govern your access to and use of the website at jact.tech, including all of its pages, content and features (the “Site”). The Site is operated by Jactechnology LLC.
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site. If you use the Site on behalf of a company or other organization, you confirm that you are authorized to accept these Terms for it, and “you” includes that organization.
The Site is meant for a business audience and is not directed to children under 13.
How we handle information is explained in our Privacy Policy and our Cookie & Storage Notice, which are separate documents. In short: the Site sets no cookies, runs no analytics, advertising or trackers, saves only two settings in your browser on its main pages (jt_lang for your language and jt_consent for your privacy choice; our older product overview page may also remember its display theme, as the Cookie & Storage Notice explains), and honors Global Privacy Control signals.
02Who we are#
The Site is owned and operated by Jactechnology LLC (“Jactechnology”, “we”, “us” or “our”), an information technology services company based in Charlotte, North Carolina, USA. You can reach us by email at jcaceres@jactechnologygroup.com.
Our client support portal at support.jact.tech is a separate service for existing clients. Your use of it is governed by your agreement with us and by any terms shown there, not by these Terms.
03Use of the site#
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- use the Site in any way that violates applicable law or the rights of others;
- interfere with, disrupt or place an unreasonable load on the Site or on the servers and networks that host it, for example through denial-of-service attacks, flooding or excessive automated requests;
- probe, scan or test the vulnerability of the Site, or breach or circumvent any security or authentication measure, without our prior written authorization;
- introduce viruses, malware or any other malicious or harmful code;
- misrepresent your identity or your affiliation with any person or organization, or impersonate anyone, including when you write to us;
- harvest our email address or other content from the Site to send unsolicited or bulk messages; or
- frame or mirror the Site, or remove or alter any copyright, trademark or other proprietary notice on it.
If you believe you have found a security vulnerability in the Site, please tell us by email instead of testing further, and do not access, change or delete data that is not yours.
Like most websites, our hosting server keeps standard access logs for security and troubleshooting, for no longer than 90 days, as described in our Privacy Policy. We may use them to investigate suspected misuse of the Site.
We may change, suspend or discontinue any part of the Site at any time, and we may restrict or block access by anyone we reasonably believe has violated these Terms.
04Intellectual property#
The Site and its content, including its text, graphics, illustrations, page design and layout, source code, the JT logo and monogram, and the names “Jactechnology” and “Multi-Retail AI”, belong to Jactechnology LLC and are protected by copyright, trademark and other intellectual property laws. All rights not expressly granted in these Terms are reserved.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable license to view the Site and to print or save copies of individual pages for your own non-commercial reference, including evaluating our services for your organization, as long as you keep all copyright and other notices intact.
Without our prior written permission, you may not copy, reproduce, modify, distribute, publicly display or sell the Site or its content, or create derivative works from them, and you may not use our logo or names in a way that suggests a partnership with, sponsorship by or endorsement from Jactechnology. No other license is granted, whether by implication, estoppel or otherwise.
Third-party software and fonts used on the Site, such as the Three.js library (MIT License) and the Inter and Space Grotesk typefaces (SIL Open Font License), belong to their respective owners and are used under those licenses. Nothing in these Terms limits your rights under those licenses.
If you believe that material on the Site infringes your copyright or other rights, please email us with enough detail for us to identify the material and contact you, and we will review it.
05No professional advice#
The content on the Site, including descriptions of our services, our security principles and the answers to frequently asked questions, is general information only. It is not technical, cybersecurity, legal, regulatory, compliance, financial or other professional advice, and it is not tailored to your systems, your business or your circumstances. Do not act, or refrain from acting, on the basis of it without advice from a qualified professional who has reviewed your situation.
References on the Site to topics such as security practices or compliance readiness describe how we approach our work. They are not a promise that any system will be free from vulnerabilities or incidents, or that your organization will meet any law, regulation, standard or framework.
Using the Site, or writing to us through the contact form or by email, does not create a client, consulting, fiduciary or other professional relationship between you and Jactechnology. Such a relationship exists only under a written agreement, as described in section 6. Sending us a message does not oblige us to reply or to provide any service.
The Site and our email address are not an emergency service. If you are dealing with an active security incident or another emergency, contact your existing IT provider, the appropriate authorities or emergency services.
06Services only under separate written agreements#
We provide our services, including IT consulting, network, infrastructure and cloud, cybersecurity, software development, managed IT and help desk, retail and POS technology, and business communications services, and access to our Multi-Retail AI platform, only under a separate written agreement signed by Jactechnology LLC and the client, such as a services agreement, a statement of work or a signed proposal.
Descriptions of services and products on the Site are summaries for general information. They are not offers that can be accepted to form a contract, and they do not describe every feature, term, limitation or exclusion. What we deliver, and the terms on which we deliver it, are set out only in the applicable written agreement. Services and features may vary by location and may change without notice.
If a written agreement between you and us conflicts with these Terms, the written agreement prevails for the matters it covers. These Terms do not amend or replace any written agreement.
07Communications#
How the contact form works
The contact form does not send anything to us and does not store anything on our servers. When you press Send, your browser prepares a draft email addressed to us in the service you choose: Gmail or Outlook on the web, which opens in a new tab, or the email app on your device. You can also copy the message and paste it into any email. Your message reaches us only if you send it from there. If JavaScript is turned off in your browser, the form opens your device’s email app. The details are in our Privacy Policy.
What you send us
You are responsible for what you send us. Please make sure it is lawful and accurate, and that you have the right to share the information it contains, including any information about other people. When you write to us, you agree that we may reply to you by email. We keep emails you send us as business correspondence for as long as needed for our business relationship or as required by law.
Email is not a secure channel
Do not send passwords, access credentials, payment card or bank account numbers, Social Security numbers, health information or other sensitive personal information through the contact form or by email. Please also avoid sending confidential business information until we have agreed in writing how it will be protected. If we need sensitive information to provide a service, we will agree on a secure method with you.
08Third-party links and services#
The Site contains links to websites and services run by others and lets you open them, for example Gmail and Outlook on the web when you use the contact form. We provide these links for convenience only. We do not control, and are not responsible for, the content, availability, security or privacy practices of third-party sites and services, and a link is not an endorsement. Your use of them is governed by their own terms and privacy policies.
If you choose Gmail or Outlook on the web in the contact form, your draft (the recipient, subject and message, and the name, email address, company and topics you entered) is passed to that provider in the web address so that it can prefill the draft. That provider handles your draft under its own terms.
Our Multi-Retail AI product overview page loads an icon font from cdnjs.cloudflare.com (Cloudflare, Inc.) and a text font from Google Fonts (Google LLC), as described in our Privacy Policy.
Gmail is a trademark of Google LLC; Outlook is a trademark of the Microsoft group of companies. Jactechnology is not affiliated with or endorsed by Google or Microsoft.
Other product and company names that may appear on the Site belong to their respective owners. Their use does not imply any affiliation with or endorsement by them.
09Disclaimer of warranties#
The Site and all content, features and materials on it are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory. To the maximum extent permitted by law, Jactechnology LLC disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Site will be uninterrupted, timely, secure or error-free, that defects will be corrected, that the Site or the server that hosts it is free of viruses or other harmful components, or that any content is accurate, complete or current. No advice or information you obtain from the Site creates any warranty not expressly stated in these Terms.
Some jurisdictions do not allow the exclusion of certain implied warranties, so some of these exclusions may not apply to you. Any warranties for our services are set out only in the applicable written agreement.
10Limitation of liability#
To the maximum extent permitted by applicable law, in no event will Jactechnology LLC or its members, managers, employees, contractors or agents be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill or data, or for business interruption, arising out of or relating to the Site or these Terms, whether based on contract, tort (including negligence), strict liability or any other legal theory, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to the Site or these Terms will not exceed one hundred U.S. dollars (US$100).
These limitations apply even if a limited remedy fails of its essential purpose, and they are an essential basis of the bargain between you and us: the Site is provided free of charge. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law. These limitations apply to the Site only; liability in connection with our services is governed by the applicable written agreement.
11Indemnity#
To the extent permitted by law, you agree to defend, indemnify and hold harmless Jactechnology LLC and its members, managers, employees, contractors and agents from and against any claims, liabilities, damages, losses, costs and expenses, including reasonable attorneys’ fees, arising out of or relating to:
- your use of the Site in violation of these Terms;
- your violation of any law or of the rights of any third party; or
- any content you send us that you did not have the right to send.
We will notify you of any such claim. We may choose to control the defense of the claim at our own expense, in which case you agree to cooperate with us. You may not settle any claim that affects us without our prior written consent.
12Governing law and venue#
These Terms, and any dispute or claim arising out of or relating to them or to the Site, are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-law rules.
You and Jactechnology agree that the exclusive venue for any such dispute or claim is the state or federal courts located in Mecklenburg County, North Carolina. Both of us consent to the personal jurisdiction of those courts and waive any objection to venue there, including on the grounds of inconvenient forum. However, either of us may seek temporary or preliminary injunctive relief in any court of competent jurisdiction to protect intellectual property rights or the security of the Site.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms. The Site is operated from the United States. If you access it from elsewhere, you do so on your own initiative and are responsible for complying with local laws. Nothing in this section limits any rights you may have under mandatory laws that cannot be waived by agreement.
13Changes to these Terms#
We may update these Terms from time to time. When we do, we will post the updated version on this page and change the “Last updated” date at the top. If a change is material, we will also note it on the Site. Updated Terms apply from the date they are posted and do not apply to disputes that arose before that date. If you keep using the Site after an update, you accept the updated Terms.
This version of the Terms is effective as of October 5, 2026.
14General#
- Entire agreement. These Terms are the entire agreement between you and us about your use of the Site and replace any prior understandings about it. They do not replace any separate written agreement for our services (see section 6).
- Severability. If any provision of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will stay in full force and effect.
- No waiver. If we do not enforce a provision of these Terms, or delay enforcing it, that is not a waiver of our right to enforce it later.
- Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, reorganization or sale of assets, or by operation of law.
- Survival. Sections 4 and 9 through 14 continue to apply after you stop using the Site.
- No third-party beneficiaries. These Terms give no rights to anyone other than you and us, except the persons protected by sections 10 and 11.
- Interpretation. Headings are for convenience only. “Including” means “including without limitation”.
- Language. These Terms are written in English. Any translation, including the Spanish version on this page, is provided for convenience only. If there is any difference, the English version controls.
